2012 CONTRACT FOR FROZEN SEMEN

This Agreement is for FROZEN transported semen from the Morgan Stallion

 MEM Bailamos 153603 entered into this day of  ______________, 2012 by and between Nau Is The Time LLC, herein referred to as Stallion Owner, and (name of breeder)

The Stallion Owner agrees to provide the mare owner with two doses of frozen semen per breeding cycle per mare. (1 dose of frozen semen is defined as 8 (eight) 0.5 ml straws approximately containing between 800 million and 1 billion sperm per straw (800 x 106 to 1 109 sperm). The mare to be inseminated is identified as follows:

The Mare Owner agrees to provide with this agreement a copy of the mare’s   registration papers.

      3. The Mare Owner hereby certifies that the mare has been examined by a licensed  Veterinarian, has a clean culture, and is breeding sound.

      4. The Mare Owner hereby certifies that he/she is the owner/lessee of the mare and  has the legal right to execute this agreement.

      5. The Mare Owner agrees to the following charges and expenses:

                   a) $500.00 Non refundable booking fee to be returned with this contract.
                   b) $1500.00 service fee for a total stud fee of $3000.00 due before release and shipment of frozen semen.
                   c) All fees and charges are payable in US dollars by check, money order, or   credit card.

       6. All fees and charges incurred for servicing the mare are for the account of the  Mare Owner.

       7. Select Breeders Services, Inc. of Colora Maryland distributes the frozen Semen of MEM Bailamos.  Charges for semen distribution and handling are solely the responsibility of the Mare Owner.  Charges incurred for tank  
           loading, deposit, rental, FEDEX shipping, and tank return to Select Breeders Services Inc are made directly through Select Breeders Services, Inc. Colora Maryland   (877)  658-3328.

       8. Neither the Stallion Owner:  Nau Is The Time LLC, Stallion Agent: Cedar Spring Farm, Inc., Select Breeders Services Inc. is responsible for lost, delayed,  r damaged semen. Semen shipped to the Mare Owner becomes the 
          property  and sole responsibility of the Mare Owner. It is the exclusive responsibility of the  mare owner to properly handle and store the frozen semen.       

       9. This FROZEN SEMEN contract carries with it a Live Foal Guarantee (LFG) If the mare fails to conceive additional doses at one dose per cycle will be  supplied to the Mare Owner until conception is achieved. If the
          mare aborts or  the resulting foal fails to stand and nurse within 24 hours of birth and dies the  Mare Owner has a “right to return” until a live foal is produced. A veterinarian  certificate stating the reproductive sate of
         the mare or condition of the foal must  accompany a request for a return breeding.

     10. Because of the LFG, this agreement entitles the Mare Owner to ONE breeding certificate for ONE mare. Should additional foals be produced from this frozen  semen, breeding certificates will be provided with a new agreement
          and additional payment of $2000.00 per foal produced.

     11. Should the mare named in this agreement becomes ill, injured, or otherwise unable to produce the Mare Owner may substitute another mare with prior consent from the Stallion Owner or Agent.

     12. The Mare Owner hereby acknowledges and agrees that he/she has read this entire agreement, which is incorporated herein by this reference and therefore  accepts all terms and conditions of this agreement.  Failure to comply 

with any of the afore mentioned terms and conditions will render this agreement null and  void with no return of monies paid.

2012 BREEDING CONTRACT VIA SEMEN TRANSPORT 
THIS CONTRACT IS NOT VALID UNLESS COMPLETED IN FULL.

I .This contract is for the 2012 breeding season made and entered into by and between:

III.   TERMS OF CONTRACT:

       A . $  500.00________ non-refundable booking fee to accompany signed contract.

       B.  $1500.00              to be paid before first shipment.

            IV. I understand and accept the following terms as conditions to this contract, prior to shipment of any semen.

             V. The designated veterinarian shall be:

                   The mare owner certifies that said veterinarian practices equine reproduction as a regular part of his practice is  available for palpation, cultures, the other necessary procedures and had consented to oversee the breeding
                   of said  mare on a regular basis.  The mare owner, understanding the veterinarian’s credentials as stated above, must be approved by the stallion owner and agrees to the following conditions:

A.      The designated veterinarian must examine the mare within 45 days prior to shipment of semen and certify in writing that the mare in free of infection and in good breeding condition.

B.       He must forward to the stallion owner written results of a uterine culture taken within 45 days prior to first shipment of semen and processed by a recognized laboratory.

C.       The provisions of A. and B. above must be repeated for any mare failing to settle within 35 and 45 days after last breeding and the results mauled to the stallion owner by certified mail.

D.      The designated veterinarian must examine the mare for pregnancy between 35 and 55 days after last breeding and the results mailed to the stallion owner by certified mail.

E.       The mare’s breeding record be signed by the designated veterinarian for pregnancy status of the mare at 55 days after the last breeding of the season.

F.       Failure to conform to A., B., C., or E., of this paragraph will completely nullify this contract. No more semen will be shipped and all guarantees will be null and void.  Furthermore no refunds will be due to anyone.

            VI.    SHIPPING CONTAINER DEPOSIT:

A.      A $250.00 deposit to be paid by certified check or money order before semen is shipped.

B.        Shipping charges from STALLION OWNER’S end will be deducted from this fee and the remainder will be refunded upon receipt of the completed BREEDING RECORD.

C.        A penalty charge of $10.00 per day will be charged for delinquent return of the container.  A maximum of 5 working days following the breeding will be allowed for return.

D.        All return shipping charges are the responsibility of the MARE OWNER

           VII.    COLLECTION FEE:    

A.        A $200.00 charge for collection for each cover which the mare owner requests semen to be shipped.

B.        Fee to be paid by certified check or money order before shipment is made.

C.        Shipments available from February 15 to August 15 of the year booked unless specified by a cutoff date for the use of fresh cooled semen after which frozen semen must be used.
